Florida introduces stricter DUI penalties effective October 1

Starting October 1, Florida is implementing stricter penalties for drivers who refuse to submit to breath or urine tests after being arrested for driving under the influence (DUI). Under the new regulations, a first-time refusal will now be a second-degree misdemeanor, carrying a one-year license suspension. Repeat offenders will face even harsher repercussions, with a second refusal resulting in a first-degree misdemeanor and an 18-month license suspension.

Florida Highway Patrol spokesman Kenn Watson emphasized the gravity of these decisions. "The bottom line is this, it is already too late when that decision must be made", Watson stated. "Do you have the right to not give a breath test or urine? Of course you do, but you have now placed yourself in a position you don’t want to be in."

A Push for Tougher Consequences

The changes are part of legislation known as Trenton’s Law, enacted in response to a tragic incident involving 18-year-old Trenton Stewart. In 2023, Trenton was killed by a wrong-way driver in St. Johns County. The driver, who had a history of vehicular homicide, received only a 15-year sentence due to the limitations of existing laws. Trenton’s case inspired lawmakers to strengthen penalties for repeat DUI offenders and those involved in fatal accidents.

Key provisions of the law include elevating penalties for repeat DUI manslaughter and vehicular homicide offenses. Previously classified as second-degree felonies with a maximum sentence of 15 years, these crimes now carry the potential for first-degree felony charges, allowing for sentences of up to 30 years for second or subsequent offenses.

DUI Statistics Highlight the Issue

Sarasota and Manatee counties have seen significant numbers of DUI citations in recent years. According to the Florida Department of Highway Safety and Motor Vehicles, Sarasota County issued 1,293 DUI citations in 2024, down from 1,645 in 2023. Meanwhile, Manatee County recorded 1,098 citations in 2024, an increase from 915 the previous year.

A Clear Message to Drivers

The introduction of Trenton’s Law also criminalizes the refusal of breathalyzer or urine tests, even for first-time offenders, marking a significant shift from prior laws, where refusals were treated as civil infractions. "Not only can this be an extremely expensive event for someone, it’s embarrassing", Watson explained. "You’re having your vehicle towed and you’re losing your freedom. More importantly, you can take the life of someone else because you simply made a bad decision."

This legislation underscores Florida’s commitment to holding DUI offenders accountable and prioritizing public safety. By introducing harsher penalties, the state aims to deter repeat offenses and reduce the devastating consequences of impaired driving.

The enhanced measures also extend to boating under the influence (BUI) offenses, ensuring that all forms of impaired operation are governed under the tougher legal framework. Trenton’s Law serves as a reminder of the consequences of reckless behavior and the importance of preventative measures to protect lives on Florida’s roads and waterways.
